Do I require permit coverage for my project?

As of December 18, 2021, Indiana no longer administers the construction stormwater program under Indiana Administrative Code (327 IAC 15-5 or Rule 5).  Permitting coverage is now issued under the Construction Stormwater General Permit (CSGP). The CSGP is a performance-based regulation designed to reduce pollutants that are associated with construction and/or land-disturbing activities.

Your project requires a Notice of Intent (NOI) to comply with the CSGP if any of the following conditions exist:

  • I am the developer, and I am installing roads, grading, infrastructure, etc. resulting in an area of disturbance greater than 1 (one) acre

  • I am a builder and the disturbed area of Project is 1 (one) acre or more

  • I am a builder, and the disturbed area of Project is less than 1 (one) acre, but part of a larger development (sub-division)
